These Terms of Service govern the use of this website and the purchase of products from Trimmed Bush Co. Limited ("we", "us", "our"). By accessing the website or placing an order, you agree to these terms.

1. General

We sell live aquarium plants and related goods within New Zealand only.

Because plants are living organisms, their appearance may vary from photos due to growth stage, trimming, seasonal conditions, or emersed vs submerged form.

We reserve the right to refuse service, cancel orders, or limit quantities at our discretion.

2. Orders

An order is confirmed once payment has been successfully processed.

We may cancel and refund orders if:

stock becomes unavailable
shipping is unsafe due to extreme weather or temperature
delivery location is unsuitable
incorrect shipping details are provided

Prices may change at any time but confirmed orders will not be affected.

3. Shipping & Delivery Responsibility

Responsibility for delivery timing and handling passes to the courier once the parcel is dispatched.

We are not responsible for delivery delays caused by:

courier network delays
weather conditions
rural delivery timeframes
missed deliveries
incorrect address entry

Customers are responsible for ensuring someone can receive the parcel promptly.

4. Live Arrival Guarantee

We offer a conditional Live Arrival Guarantee on live plants.

Eligibility, timeframes and claim requirements are described in our Shipping & Live Arrival Policy, which forms part of these Terms of Service.

Claims must be submitted according to that policy. Where eligible, we may refund or replace affected plants at our discretion.

Plants are perishable goods and are not eligible for change-of-mind returns.

5. Plant Behaviour Disclaimer

Aquarium plants naturally adapt after planting. Leaves may melt, change colour, or shed during transition. This is normal biological behaviour and not a defect.

By purchasing live plants you acknowledge responsibility for providing suitable aquarium conditions including lighting, nutrients and water parameters.

6. Returns & Refunds

We do not provide refunds or returns for change of mind, incorrect selection, or no longer wanting the item.

Live plants are perishable goods and cannot be returned. Refunds or replacements for live plants are only available under the Live Arrival Guarantee and must meet the requirements in the Shipping & Live Arrival Policy.

Shipping charges are non-refundable once an order has been dispatched.

If a product is faulty or not as described, we will meet our obligations under the Consumer Guarantees Act 1993.

Nothing in these terms limits your rights under the Consumer Guarantees Act 1993.

7. Accuracy of Information

We aim to provide accurate care guidance, but aquarium outcomes depend on many variables beyond our control. Advice provided is general guidance only.

Customers remain responsible for aquarium care decisions.

8. Limitation of Liability

To the maximum extent permitted by New Zealand law, Trimmed Bush Co. Limited is not liable for:

livestock loss
tank crashes
algae outbreaks
plant loss after planting
indirect or consequential damages

Our liability is limited to the value of the purchased products.

Nothing in these terms overrides rights under the Consumer Guarantees Act 1993.

9. Intellectual Property

All website content including images and branding remains the property of Trimmed Bush Co. Limited and may not be reused without permission.

10. Changes to Terms

We may update these terms at any time. The current version will always appear on this page.
